1. Agreement Overview
These Terms of Service establish a legally binding agreement between you and Spinyak governing your use of our social casino platform. By accessing or using any part of Spinyak, you agree to comply with and be bound by these terms in their entirety.
If you disagree with any part of these terms, you must immediately stop using the platform. We reserve the right to modify these terms at any time, and your continued use after such modifications constitutes acceptance of the updated terms. It's your responsibility to review these terms periodically.
2. User Eligibility and Age Requirements
Spinyak enforces a strict minimum age requirement of 18 years for all users. This requirement is absolute and applies regardless of your location or local age of majority. By using this platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements.
We implement age verification systems to enforce this requirement. Providing false age information, attempting to circumvent verification measures, or allowing minors to access the platform through your device constitutes a serious violation that may result in immediate termination and potential legal consequences.
3. Nature of the Platform
Spinyak operates exclusively as a social casino platform for entertainment purposes. This is not a real money gambling site. All games use virtual currency that has absolutely no monetary value and cannot be exchanged for real money, goods, or services under any circumstances.
No purchases are required to access or enjoy our games. No deposits can be made. No withdrawals are possible. The platform exists solely to provide entertainment through casino-style games in a completely risk-free environment.
4. Acceptable Use Guidelines
You agree to use Spinyak only for lawful purposes and in ways that don't infringe on the rights of others or interfere with the platform's normal operation. Prohibited activities include but are not limited to: attempting to hack or exploit games, using automated systems or bots, creating multiple accounts, reverse engineering platform code, harassing other users, or using the platform for any unauthorized commercial purposes.
We reserve the right to investigate suspected violations and take appropriate action, including immediate termination of access, without prior notice or liability.
5. Intellectual Property Rights
All content on the Spinyak platform, including games, software, graphics, text, logos, audio, video, and code, is owned by or licensed to Spinyak and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal entertainment only.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any platform content without our express written permission. Unauthorized use may result in termination of access and legal action.
6. Platform Availability and Changes
While we strive to maintain consistent platform availability, Spinyak is provided on an "as is" and "as available" basis. We don't guarantee uninterrupted or error-free service. The platform may be unavailable due to maintenance, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time without prior notice. This includes adding or removing games, changing features, updating designs, or altering functionality. We're not liable for any consequences resulting from such modifications or unavailability.
7. Warranties and Disclaimers
Spinyak makes no warranties or representations about the platform's accuracy, reliability, functionality, or fitness for any purpose. We disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that the platform will meet your expectations, that operation will be uninterrupted or error-free, or that defects will be corrected. You use the platform entirely at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Spinyak and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we've been advised of the possibility of such damages.
Our total liability to you for all claims shall not exceed the amount you paid us for platform access. Since the platform is free to use, this effectively limits our liability to zero in most circumstances.
9. Termination Rights
We reserve the right to terminate or suspend your access to Spinyak immediately, without prior notice or liability, for any reason including breach of these terms, suspected fraudulent activity, or at our sole discretion.
Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.
10. Governing Law and Disputes
These Terms of Service shall be governed by applicable laws without regard to conflict of law provisions. Any disputes arising from these terms or your use of Spinyak shall be resolved through binding arbitration, except where prohibited by law.
You agree to resolve disputes individually and waive any right to participate in class action lawsuits. If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.
